User registration and service agreement
This is an agreement between you (“you” or "User") and StarChat, a voice interactive entertainment social tool.
The design, performance, interpretation and settlement of disputes of this Agreement apply to the laws of the People's Republic of China, and exclude the application of all other conflict laws. This agreement was concluded in Panyu District, Guangzhou City. In the event of any dispute between StarChat and you, regarding the content of this Agreement or its execution (including but not limited to contracts or other property rights disputes), the dispute shall be settled through friendly negotiation; when the negotiation fails, both parties agree to submit the [Guangzhou] Arbitration Commission to conduct arbitration in accordance with the rules implemented by the Commission at the time of applying for arbitration. The arbitral award is final and binding on both parties.
1. Important notes
1.1 Users who want to access and use the "StarChat" software must carefully read and fully understand the terms of this agreement, including the exemption and limitation of the "StarChat" liability and the restrictions on the user's rights.
If you does not agree to this agreement, you should refuse to use or actively cancel the service provided by "StarChat". If you use a third-party account to log in, please also read this agreement carefully, and your use will be considered unconditionally and completely acceptable to this agreement.
1.2 Special Note: Please confirm that you have full civil capacity. Unless you are 18 years old or you are 16 years old and rely on your own labor income as your main source of income, please stop registering or using the services under this agreement.
1.3. After the user accepts this agreement, this text may be modified due to changes in national policies, products, and the environment in which this agreement is implemented. The revised agreement will be published in all products of "StarChat" (including but not limited to APP, Website). After the revised agreement is announced seven days later, it will be regarded as "StarChat" and the user has been notified of the modification of the agreement. If the user disagrees with the revised agreement, please stop accessing or using the "StarChat" software immediately. If the user continues to access or use it, it will be deemed to have approved the revised agreement.
1.4 "StarChat" currently provides users with a wealth of Internet services, including but not limited to voice communications, chat rooms, etc. If a particular service has separate agreements, rules, or guidelines, users must abide by the separate agreement, rules and the guidelines, users accept all other services should comply with this agreement.
2. "StarChat" account registration rules
2.1 The registration information of "StarChat" account includes but not limited to the user's account name, avatar, password, and all the other information entered when registering or updating the account, and also all the information entered by the user when using the individual services of "StarChat".
2.2 Users are not allowed to enter the following illegal and undesirable information in the registration data:
(1) Information that violates the provisions of the Constitution or laws and regulations;
(2) Information that endangers national security, reveals state secrets, subverts state power, and undermines national unity;
(3) Information that damages the national glory and interests and harms the public interest;
(4) Information that Incites ethnic hatred, ethnic discrimination, and undermines national unity;
(5) Information that destroys the state's religious policy and promotes information about cults and feudal superstitions;
(6) Information that spreads rumors, disrupts social order, and undermines social stability;
(7) Information that disseminates obscenity, pornography, gambling, violence, murder, terror or abetment;
(8) Information that insults or slanders others, infringes on the legitimate rights and interests of others;
(9) Information containing other content prohibited by laws and administrative regulations.
If the registration information provided by the user is inaccurate, untrue, or illegal, we reserve the right to refuse your registration and reserve the right to terminate the use of our services. If the user fraudulently obtains the account registration with false information, or the registration information contains illegal and bad information, we have the right to: notify the user to correct within a time limit, suspend, cancel the user’s registration and other measures. "StarChat" has the right to cancel the account registered with associated institutions or celebrities, and report it to the government.
In accordance with the relevant laws, regulations and the importance of the "StarChat" service, the users agree to:
(1) Proactively submit personal valid identity information for real-name authentication;
(2) Provide detailed and accurate account registration information (name, mobile phone number, etc.) in time;
(3) Constantly update the registration information, in line with timely, detailed and accurate requirements, and the identity document information "StarChat" account cannot be modified after registering.
The users agree that the true, accurate and legal "StarChat" account registration information is the only evidence that identifies the user's association with his account and the identity. While using "StarChat", users agree to accept all kinds of information services provided by "StarChat". "StarChat" reminds the user that the user will not be able to modify the ID number of the account after filling it. Please fill in the registration information very carefully.
In order to enable users to timely and comprehensively understand the services provided by the "StarChat" company, the users agree that "StarChat" can send various commercial messages to users constantly in a long time.
The user agrees to all materials, data and records related to the registration and use of the "StarChat" account, including but not limited to the account, registration data, all logins, consumption records and related usage statistics, etc., are belong to "StarChat". In the event of a dispute, the user agrees to use the system data of "StarChat", and "StarChat" guarantees the authenticity of the data.
2.3 All data generated by users using the "StarChat" account is owned by "StarChat", including but not limited to login records, consumption records, customer service records, and the social content created by users in "StarChat", etc. In the event of a dispute, the user agrees to the system data of "StarChat".
2.4 Users may not transfer or lend their account number or password to others. If the account or password is illegally stolen, used or suffered due to hacking or negligence of the user, "StarChat" does not assume any responsibility; if damage is caused to "StarChat", the user shall be compensated.
2.5 If the user's account has not been logged in for 180 consecutive days from the last login, "StarChat" has the right to take measures, including but not limited to logout, recycle, replace or delete all record in the "StarChat" platform database (including but not limited to registration information, virtual gift information, etc.), etc., the corresponding service provided by "StarChat" is terminated at the same time.
"StarChat" will notify the user with pop-ups, website announcements, in-site messages, client push information, etc., within 30 days("Notification Period") before the account is cleaned up. If the user reactivates the account as the approval way with the notification period after receiving the notice, it will be deemed to automatically waive the information and virtual assets contained in the account, including but not limited to data and virtual gifts, the right to claim, recourse and compensation for information, virtual assets, etc.
2.6 Special Note: Users can only use the legal currency of the People's Republic of China (ie. RMB/¥) to recharge the "StarChat" platform and redeem it for the platform virtual currency “Gold Coin”; “Gold Coin” can only be used in "StarChat" to purchases gifts, etc., or participates in platform activities, and it cannot be exchanged for RMB or realistic reward.
3. Platform Service Rules and User Code of Conduct
3.1 The user shall not use the following prohibited behaviors as stipulated in the “Administrative Measures for Network Performance Management Activities” when using the software:
3.1.1 Contains the prohibited content as stipulated in Article 16 of the Interim Provisions on the Administration of Internet Culture;
3.1.2 The manner of performance is horrible, cruel, violent, vulgar, and ruin the physical and mental health of the performer;
3.1.3 use the human body defect or to show the human body variation and other means to attract users;
3.1.4 Infringe on the lawful rights and interests of others by means of sneak shots and other methods;
3.1.5 performing in a manner such as animal cruelty;
3.1.6 Use online game products that have not obtained the cultural review department approval content number or filing number to display or explain online game techniques.
If “StarChat” finds out that the user have done things mentioned above, the user agrees and accepts “StarChat” according to the punishment measures, including but not limited to suspending the live broadcast service, sealing the account, deducting the virtual props, deducting the gold coins, blocking the equipment, etc.
3.2 Users may not use the services of the Software to create, copy, distribute, transmit or store the following obscene pornographic information, including but not limited to:
3.2.1 Disperse obscene and pornographic content, including but not limited to recruiting, looking for a one-night stand, a sexual partner, a voice, and even sleeping with a bed;
3.2.2 pornographic and sexually suggestive information content, in order to achieve the purpose of attracting users;
3.2.3 Erotic voices, erotic characters, erotic videos, erotic comics, etc. for pornography, but not limited to the above.
If the user violates this Agreement, “StarChat” will have the right to make penalties for illegal users including but not limited to freezing accounts, permanently banned accounts, banned devices, deducting virtual items, deducting gold coins.
3.3 Users may not use the services of the Software to create, copy, distribute, transmit or store the following violent gambling information, including but not limited to:
3.3.1 Disperse the actual content of the person or animal being killed, maimed, and injured, such as shooting, stabbing, torture, etc.;
3.3.2 Contents depicting violence, self-harm, etc.;
3.3.3 relates to disturbing bloody scenes;
3.3.4 The content of real weapons is described for the purpose of encouraging illegal or reckless use;
3.3.5 Send the organization to gather gambling, sell gambling equipment, teach gambling (thousands of skills) skills, methods, methods, etc.;
3.3.6 Promote bloody and violent content that violates human morality.
If the user violates this Agreement, "StarChat” has the right to make the following violations for the illegal users according to the specific circumstances: If the user violates the above regulations for the first time, then "StarChat” will impose a 24-hour penalty on the user to freeze the account; If the user violates the above regulations for the second time, then “StarChat” will impose a penalty of 3 days for the user to freeze the account; If the user violates the above regulations for the third time, then “StarChat” will impose a penalty of 15 days for the user to freeze the account; If the user violates the above regulations for the fourth time, then "StarChat” will impose a penalty on the user to permanently freeze the account. If it is determined by the "StarChat” that the user's illegal violations are serious, then "StarChat” has the right to directly impose a penalty on the user to permanently freeze the account or block the device when the user violates the above regulations for the first time.
3.4 Without the authorization of “StarChat”, users may not use the services of this software to create, copy, publish, distribute and store the following advertising and promotional information, including but not limited to:
3.4.1 Promote other platforms, commodities, shop speeches and pictures;
3.4.2 Leave WeChat number, QQ number, phone number, etc. to lead to other platforms, suspected of fraud, illegal profit-making advertising behavior;
3.4.3 Promote the anchor/spot number/room number of StarChat” or other live broadcast platform, seek for local tyrants, ask for flowers, etc., and guide to other sections of the product advertising behavior;
3.4.4 Sending content of products that are prohibited by the state from being sold or not obtained by the state administrative license;
3.4.5 Sending false propaganda and other non-conformity to the brush room/brushing virtual item rules, selling the brush room, personal attention to software and other improper profit content;
3.4.6 Send organization and publicity network part-time content;
3.4.7 maliciously smashed the "StarChat” platform, maliciously disrupting platform rules and other behaviors.
If the user violates this agreement, "StarChat” has the right to make the following restrictions on the user according to the specific circumstances: but not limited to the following punishments: If the user violates the above regulations for the first time, then "StarChat" will impose a 24-hour penalty on the user to freeze the account; If the user violates the above regulations for the second time, then “StarChat” will impose a penalty of 3 days for the user to freeze the account; If the user violates the above regulations for the third time, then “StarChat” will impose a penalty of 15 days for the user to freeze the account; If the user violates the above regulations for the fourth time, then "StarChat" will impose a penalty on the user to permanently freeze the account. If it is determined by the “StarChat” that the user's illegal violations are serious, then “StarChat” has the right to directly impose a penalty on the user to permanently freeze the account or block the device when the user violates the above regulations for the first time.
3.5 Users may not use the services of the Software to create, copy, distribute, transmit or store content that violates the following ethical behaviors, including but not limited to:
3.5.1 maliciously harassing users, especially female users;
3.5.2 Swearing, insulting others, slandering others, personal attacks;
3.5.3 maliciously flooding, swiping the screen, maliciously repeating comments, and publishing content or speech that is clearly inconsistent with the community atmosphere;
3.5.4 involves leaking the privacy information of others and infringing on the legitimate rights and interests of others;
3.5.5 The release obviously does not meet the chat room theme and the specification content;
3.5.6 Other acts that infringe upon the lawful rights and interests of others.
If the user violates this Agreement, “StarChat” has the right to make the following violations according to the user's violation of the law, including but not limited to the following penalties: If the user violates the above regulations for the first time, then the user will be given a 24-hour penalty for freezing the account; if the user violates the above regulations for the second time, then we will impose a penalty of 3 days for the user to freeze the account; if the user is the third time In violation of the above regulations, “StarChat” will impose a penalty of 15 days for the user to freeze the account; if the user violates the above regulations for the fourth time, “StarChat” will impose a penalty on the user to permanently freeze the account. If the user violates the law and the circumstances are serious, then “StarChat” has the right to directly impose a penalty on the user to permanently freeze the account or block the device when the user violates the above regulations for the first time.
3.6 Users understand and agree that StarChat” provides users with relevant services in order to allow users to experience rich and colorful web service content instead of using the service to earn real-world money or economic benefits. Therefore, users promise not to engage in online performance services for profit, and any act of performing services for profit purposes will be considered as illegitimate interests, including but not limited to:
3.6.1 The same user (refers to the same mobile phone, the same ID number, the same device number, the same IP) uses multiple user accounts to increase the popularity of the anchor and the virtual gift for the purpose of profit;
3.6.2 Promising monetary benefits in advance, requiring other users to increase the popularity of their own accounts, giving virtual props, etc.;
3.6.3 Profiting the trading of user accounts or virtual items on a trading platform that is not provided or recognized by “StarChat”;
3.6.4 Selling other users' accounts or virtual items by means of hacking, fraudulent account passwords, etc.;
3.6.5 Any other profit-making behavior that is not intended for normal entertainment interaction needs.
“StarChat” has the right to take penalties for users who take illegitimate interests, including but not limited to suspending live broadcast services, suspending accounts, deducting virtual items, deducting gold coins, and banned equipment. If you are causing a loss to the “StarChat”, “StarChat” has the right to claim compensation.
3.7 In addition to the above-mentioned 3.1-3.6, we will publish specific operational rules (such as StarChat Community Specification”) on the official website and client end of “StarChat” from time to time. Users agree to abide by the above operational rules. If the user violates the relevant operational rules, the user agrees and accepts that we will impose penalties, including but not limited to suspending live broadcast services, suspending accounts, deducting virtual items, deducting gold coins, etc.，according to the rules.
3.8 If the user infringes the legitimate rights and interests of the third party during the use of the live video service, the user shall bear the corresponding responsibility, and “StarChat” does not need to bear any responsibility. In the event of a user’s infringement causing “StarChat” to be infringed by a third party, the user shall bear all costs we paid in response to such allegations (including but not limited to attorneys’ fees, legal fees, travel expenses, etc.). And we have the right to request compensation from the user.
3.9 Users shall not reverse engineer, reverse assemble or reverse compile the software; you shall not use third party plug-ins to interfere with, modify or destroy the software; you shall not use the software's possible bugs or rule loopholes to obtain illegitimate interests.
4. Inform the statement
4.1 The user is aware that users may be subject to malicious distribution, implementation, including but not limited to threatening, defamatory, offensive or illegal content from the “injured person” when using the “StarChat” service. Intrusion, or the user’s legal rights (including but not limited to intellectual property rights, virtual assets, etc.) are infringed by the “injured person” regardless of whether they are anonymous or impersonated, and the user undertakes to unconditionally assume the above risks and exempt any claim in the “StarChat”.
“StarChat” does not guarantee the services provided, whether explicit or implied, including all implied warranties regarding the authenticity, merchantability, fitness for a particular purpose, ownership and non-infringement. condition. It is not responsible for any direct, indirect, incidental, special or consequential damages resulting from any improper or illegal use of the Services by the User.
4.2 When using the “StarChat” service, you must abide by relevant national laws and policies, safeguard national interests, protect national security, and abide by these Terms.
The user is solely responsible for all liability arising out of the user's violation of the law or the use of this agreement.
4.3 “StarChat” service is as susceptible to various security issues as most Internet products, including but not limited to:
4.3.1 The user's detailed personal data is illegally obtained and used by criminals, causing harassment in real life;
4.3.2 spoofing and deciphering passwords;
4.3.3 Other software downloaded and installed contains viruses such as “Trojan Horse”, which threatens the security of information and data on personal computers and threatens the use of the service.
In the event of the above, the user shall be responsible for it.
4.4 Users understand that the “StarChat” service interruption or account item loss may result in Internet technology instability, government policy regulation, virus intrusion, hacking, server system crashes or other risks that cannot be solved by today's technology. In the event of any loss to the user due to the above reasons, the user undertakes that such loss shall be borne by the user and the user shall unconditionally waive any claim for “StarChat” for the above reasons.
4.5 “StarChat” does not guarantee the effectiveness, publicity and accuracy of the advertisements or information posted on this website. Users should be cautious in their own discretion when contacting these advertisements or information, and the user promises that any loss suffered by the user due to the use of advertisements or information posted on this website shall be resolved by the user and the publisher, and the user shall unconditionally waive the right to take the above claims to “StarChat”.
4.6 The User agrees that “StarChat” will send service information and commercial advertisements to the device or software that receives the information, including but not limited to fixed telephone, mobile phone, email, QQ, Weibo, WeChat, etc.
4.7 In the process of using the “StarChat” service, any disputes and/or losses suffered by other users will be resolved by the users themselves and bear the corresponding responsibilities. It has nothing to do with “StarChat”.
5. Intellectual property rights
5.1 StarChat has all complete intellectual property rights for the following contents: "StarChat" text, pictures, videos, audio, software and other elements, "StarChat" service logo, icon and patent rights.
5.2 Users may only use the intellectual property rights of “StarChat” in the scope of this Agreement and the corresponding license agreement (“Scope of Use of Intellectual Property”). Unauthorized use beyond the scope of "use of intellectual property rights" constitutes an infringement of the intellectual property rights of "StarChat". "StarChat" has the right to take such measures including but not limited to warnings, litigation, arbitration, etc. to protect legitimate rights and interests.
5.3 The intellectual property rights of user-originated information such as texts, pictures, videos, software and performances uploaded and published by users when using the "StarChat" service are owned by the user, and the user agrees that the act of posting and uploading on the “StarChat” platform is the authorization of the "StarChat" service platform. The user confirms the non-exclusiveness of the information published and uploaded, and is also a permanent authorization for "StarChat", and the authorization can be transferred to the authorization. “StarChat” can use the above information for free on the service platform of "Xiamen StarChat", and we can use it again after editing, and authorize it to be used by our partners.
5.4 If the information in the “StarChat” software and the information uploaded, stored and disseminated by other users infringe the intellectual property rights of the third party, the infringe may report the complaint to the complaint channel provided by “StarChat”, “we will have the right to take reasonable measures to deal with the above-mentioned violations.
6. Charge service
6.1 Some features or applications of "StarChat" involve payment, the user's click to agree/confirm the behavior of this agreement is deemed to accept and subscribe to the charging service. Once the user accepts the subscription charging service, the user will be required to pay the corresponding fee according to the charging standard published by "StarChat".
6.2 When you are spending, please understand the price and the matter in advance; if you are a minor, please consume it after the guardian's approval.
6.3 The rights obtained by the user after payment shall not be transferred to a third party.
7. Privacy protection
7.1. Please be careful not to disclose all kinds of your property information, such as bank account, bank card, credit card, third-party payment account and its password in the "StarChat" service, otherwise any losses will be borne by you.
7.2. Users may not post or upload information that they think is private to "StarChat" when using the service, or broadcast the information to others through the "StarChat" service. If the privacy leakage caused by the user's own behavior, the user is responsible for it.
7.3. "StarChat" may collect users’ information when providing services, we will clearly inform the users. Usually the information is limited to the user's name, gender, age, date of birth, ID number, home address, and education level, job situation, industry, hobbies, etc.
7.4. The user knows and understands that "StarChat" does not assume any legal responsibility for the occurrence of the following related matters:
7.4.1 "StarChat" provides your personal information as required by law or by relevant government or judicial authorities;
7.4.2 any leakage of personal information caused by the user, such as user informs others or shares the registered account with important information, or other leakage of personal information caused by "StarChat";
7.4.3 Any information leakage caused by hacker attacks and computer virus intrusion;
7.4.4 Information leakage due to force majeure;
8. Other terms
8.1. The headings of all the terms of this Agreement are for convenience only and have no actual meaning and cannot be used as a basis for interpretation of the meaning of this Agreement and related terms.
8.2. If any provision of this Agreement is determined to be wholly or partially invalid or unenforceable for any reason, the other terms of this Agreement shall remain valid and enforceable.
When "StarChat" does not exercise, fails to exercise in time, or does not fully exercise this Agreement or the rights enjoyed by law, it should not be considered as a waiver of this right, nor does it affect the "StarChat" to exercise this right in the future.
8.3. If the “StarChat Community Management Regulations” or other specific operational rules are inconsistent or conflict with this Agreement, the provisions of the “StarChat Community Management Regulations” or specific operational rules shall prevail.
